NACS Position - Cannabinoids, Kratom and Not Legal Products

The NACS Show welcomes exhibitors who are selling legal products marketed in a lawful manner. Products that are, or that contain any ingredient or constituent part that is, illegal or unlawfully marketed in the United States, the State of Nevada, or the City of Las Vegas are strictly prohibited at the 2026 NACS Show.

While NACS does not independently evaluate the legality of the products shown in the exposition, exhibitors are required to warrant compliance with applicable federal, state, and local laws. If NACS becomes aware of an exhibited product that is illegal or unlawfully marketed, the product will be removed from the NACS Show.

Additional product-specific restrictions and advisories apply to cannabis, kratom, and nicotine products at the NACS Show, as outlined in the sections below. Some states and localities further regulate or prohibit the sale of these products; attendees of the NACS Show should check their state and local laws, and may wish to consult qualified legal counsel, before agreeing to sell these products in their stores.

Cannabis Products

“Cannabis products” include products containing cannabis or any of its cannabinoid components, like cannabidiol (CBD) and tetrahydrocannabinol (THC) or their analogues, whether hemp-derived or marijuana-derived, as well as synthetic cannabinoids.

IMPORTANT NOTICE for 2026 NACS Show exhibitors regarding the legal status of hemp-derived THC products:

Effective in November 2026, a new federal law will ban the sale of hemp-derived THC products that exceed 0.4 mg total THC per container or 0.3% total THC by dry weight. The ban will apply to all THC compounds (not just Delta-9 THC), meaning most products currently marketed as hemp-derived CBD products will also be banned in their current formulations.

There are ongoing legislative efforts seeking to change or repeal this new law, which NACS continues to monitor closely. However, if the ban remains in place as of August 1, 2026, confirmed exhibitors of impacted products may have their 2026 NACS Show booth space cancelled for a full refund. No exhibitor may sell, distribute, or openly possess cannabis products in any form at the NACS Show. NACS members that manufacture or distribute hemp-derived cannabinoid products are eligible to participate as exhibitors at the 2026 NACS Show in Las Vegas, subject to the following:

  • Promotional materials for hemp-derived cannabinoid products, including product labeling and empty packaging for display purposes, are permitted.
  • Offering samples or other opportunities to use or consume cannabis in any form, including hemp-derived cannabinoid products, is prohibited.
  • Exhibitors must agree to the 2026 NACS Show Terms & Conditions Addendum for Cannabis Products.

Attendees of the NACS Show are advised of the following with respect to cannabis products:

  • Marijuana and marijuana-derived cannabinoid products remain illegal under the federal Controlled Substances Act, despite the many state laws aimed at legalizing those products for medicinal or recreational use.
  • The U.S. Food & Drug Administration (FDA) has not approved for retail sale any hemp-derived cannabinoid products that are ingestible or that make health claims.
    • The FDA maintains that the sale of such products is therefore illegal under the Federal Food, Drug & Cosmetic Act. This position does not apply to topical hemp-derived cannabinoid products that are not ingested, so long as they do not make health claims.
    • Any such products for which promotional materials are displayed at the 2025 NACS Show are not yet legally on the market according to FDA, but may be sold in the marketplace following FDA approval or regulatory action.

Kratom Products

”Kratom products” include products containing kratom or any of its alkaloid components, like mitragynine and 7-hydroxymitragynine (7-OH) or their analogues, whether naturally or synthetically derived.

No exhibitor may sell, distribute, or openly possess kratom in any form at the NACS Show. NACS members that manufacture or distribute kratom products are eligible to participate as exhibitors at the 2026 NACS Show in Las Vegas, subject to the following:

  • Promotional materials for kratom products, including product labelling and empty packaging for display purposes, are permitted.
  • Offering samples or other opportunities to use or consume kratom in any form is prohibited.

All attendees of the NACS Show are advised of the following with respect to kratom products:

  • The U.S. Food & Drug Administration (FDA) states that “kratom is not lawfully marketed in the U.S. as a drug product, a dietary supplement, or a food additive in conventional food.”

Nicotine Products

“Nicotine products” include cigarettes, cigars, hookah, smokeless tobacco, oral nicotine pouches, electronic nicotine delivery systems, and similar such products containing tobacco, tobacco-derived nicotine, or synthetic (non-tobacco-derived) nicotine.

NACS members that manufacture or distribute nicotine products are eligible to participate as exhibitors at the 2026 NACS Show in Las Vegas, subject to the following:

  • Nicotine products not commercially marketed in the United States on or before February 15, 2007, are prohibited unless:
    • the U.S. Food & Drug Administration (FDA) has issued a favorable written decision in response to a premarket tobacco product application (PMTA), a substantial equivalence (SE) report, or an exemption from substantial equivalence request (EX REQ); or
    • for tobacco-derived nicotine products, the manufacturer of the product filed a PMTA on or before September 9, 2020, and the PMTA has not yet been granted, or is the subject of a pending court action or administrative reconsideration.
